Perpetuating Illegality in ‘National Interest’

Given the scope of ED’s powers, the Court could have at least ensured that it works within a legal mandate.

By extending the illegal tenure of the director of the Directorate of Enforcement to 15 September 2023, the Supreme Court has ended up damaging its credibility further. Its order of 27 July 2023, modifying its earlier order and allowing this extension, has made a mockery of the notion of finality of judicial orders, showing that compliance with orders is not mandatory and may be subject to the convenience of the union government. Though it has used the fig leaf of “national interest,” by extending the tenure of S K Mishra, the Supreme Court has only ended up undermining itself.
