Examining Local Committees under the Sexual Harassment of Women at Workplace Act

One of the major milestones of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 is to provide a special redress mechanism for complaints in the unorganised sector. Section 7 of this act mandates the constitution of local committees by the state government. However, there remains a lack of data when it comes to understanding the functioning of the local committees. This paper examines the functioning of the local committees in general, based on the experiences of the author as an acting chairperson of the Mumbai city district local committee.

Violence against women perpetrated by men is gender-based and socially shaped. As argued by Millett (1970), in all societies, the relationship between the sexes has been based on power and is, therefore, political. It shapes in the form of domination by men over women in all areas of life. Walby (1990) defines patriarchy as a system of social structures and practices in which men dominate, oppress, and exploit women. The structural aspect of patriarchy is manifested in the hierarchical organisation of social institutions and relations, while the ideological aspect reinforces and supports inequality and subordination (Dobash and Dobash 1979). Patriarchy in the economy as a social institution becomes obvious in the form of gender bias in labour force participation1 and sexual harassment in the workplace.
