The people of Jammu and Kashmir believe Mohammad Afzal Guru was denied a fair trial, the opportunity to contest the rejection of his mercy petition, and an opportunity to meet his family before his secret execution. It is a grave human rights violation. India considers his dead body as seditious and the body has been subjected to continued “imprisonment”. The way Mohammad Afzal Guru’s rights in the matter of the fate of his body and final burial have been denied represents a serious violation of human rights and a gross disregard of the sentiments of the people of Jammu and Kashmir.

The Indian state has no legal or moral right over the body of Mohammad Afzal Guru and it must be returned to his family.
The denial of the return of his dead body only strengthens the understanding of the people of Jammu and Kashmir that the Indian state continues to disregard the civil and political rights of the people in its ongoing belligerent policy for the control of territory.
