ders and Other Instruments) Rules, 1958, the Court was precluded from calling in question the validity of the said notifications. The effect of proper authentication is clearly mentioned in Article 77(2); "the validity of an order of instrument which is so authenticated shall not be called in question on the ground that it is not an order or instrument made or executed by the President." If a properly authenticated order must be deemed in law to have been made by the President himself, there is no reason for its reference to the Council of Ministers or to the President* as Justice Jain suggests. The fact that the President has "not allocated the matter to any Minister" under the Rules of Business becomes immaterial in the face of an order of the President himself.
