October 11, 1975 LABOUR A Basic Right Denied (From a Legal Correspondent) THE decision of the Supreme Court in the case of Premier Automobiles verms Kamalkar Shantaram Wadke [Civil Appeal No 922 (NL) of 1973 decided on August 26, 1975] has the effect of depriving the working class of its right to approach a civil court to ask for an injunction preventing an employ er from committing a breach of an obligation imposed upon him by law. This simple right, namely, the right to obtain an injunction preventing anybody from committing a breach of an obligation imposed upon him, is available to ail under the Specific Relief Act 1963. But no longer to the working class, after the decision of the Supreme Court in the above-mentioned case.
