The United States Supreme Court's 29 April 2014 opinion has in it the elements of both further pressure on India for providing greater access to US markets for renewable energy technologies and relevance for the resolution of India's interstate disputes. This article explains the salient points.

India's Maritime Jurisdiction

The Supreme Court of India's ruling in the case of the two Italian marines who shot two Indian fishermen to death, underscores the objective territorial principle of jurisdiction. It is also a measure of both acquiescence in the protective and passive personality principles of jurisdiction and a recognition of the restrictions on jurisdiction under international law.

WTO and Tariff Preferences

To the extent that the trade diversion caused due to the EC's discriminatory tariffs under the drug arrangements is set right, the tariff preferences case is clearly a victory for India. But it is a tall claim that the WTO appellate body ruling is also a timely reminder that trade policy instruments cannot be used to serve political objectives.

The WTO panel report on the Indo-US dispute over rules of origin in textile and apparel products imports shows how the Agreement on Rules of Origin could be used, and how inequitable its resolution could be. It also shows that protectionism could take new forms, and confirms some of India's worst fears if origin could be conferred other than on the basis of the restrictive criteria of substantial harmonisation of the rules of origin.

WTO Panel Report on Indian Steel

The panel report on the dispute regarding US imposition of anti-dumping duties on Indian steel plate exports highlights how crucial is the necessary information demanded of an exporter in such an investigation, and how difficult its submission could be for a developing country in a time frame and format imposed by the investigating authorities.
